Searching in the internet, I found some companies that sell mine claims.  Shocked

What is the main purpose of a mine claim?  Idea

Does the mine claim prevent not authorized persons to search for gold in that areas?  Detecting Violent

Is it legal to sell mine claims?  Police

Mine Claims are generally a legal right to work an area as claimed or staked in the claim which has been granted by an authorised authority, generally a government department for Minerals and Resources/Mines. Generally this right can be granted to individuals (although rare) more common to corporate entities commonly for a fee.

These rights generally allow the holder to work their claim which in many cases can be on land otherwise legally owned by others.

We have examples of this happening right now around were I live in the Australian Capital Territory, whereby farmers just over the boarder in NSW are at threat by mining companies which are filing claims on their farms to mine metals such as Gold, Copper and Silver. Unless these farmers are smart and file claims to mine their own farms they are at risk of not having much they can do to stop this from happening.

It has a lot to do with the fact government regard the mineral and metal wealth (resources) as more common property to which they take control of these resources, supposedly on behalf of their national interest (everyone). If these can be mined and in turn return dollars to them by way of resource taxes and also increased employment they are happy. Land ownership takes second or third place in this respect.

If you do not hold the legal right to work an area, even for your own property to which someone else has a legal claim you do not have the right to work it and anything you may find could be claimed as being owned by the mining claim holder.

Such claims can be traded or sold, however this can get tricky and you would not to enquire into your own local laws and requirements for this information.

P.s Be very aware of the risks of buying claims as I'm sure many scams have been hatched in such area's. You really would need to do your research and question why they would be selling claims if they were so good in the first place and not working them for their own gain....Huh?

And yes I myself would be very pissed if someone tried that on me. Already I have advised several property owners to file their own claims and lock them out.

The other side of this I guess is that there could come a point where all subterranean wealth is held on private lands... No mining no wealth and no gain...Interesting

The best advise about a mining claim is - BUYER BEWARE.

You had better walk it yourself - and SAMPLE it yourself.

You should carefully check out all the paperwork and make sure that it is in order. 

In the U.S. most claims must have an approved Plan of Operations (PoO). 

Here in Arizona I've spent over 2 years just trying to get a PoO for a 20 acre hard rock claim on land that was previously mined - just to use HAND TOOLS!  US Forest Service (FS) is SLOW and in NO HURRY to finalize the PoO.  Some claims have had PoOs in the hands of the FS for over 10 years!

Some US lands are managed by the Bureau of Land Management (BLM); often these lands are somewhat easier to get authorization to start working.

Ask a lot of questions - consider seeing a mining attorney or mining consultant.

Definition mining claim ; A description by boundaries of real property in which metal ore and/or minerals may be located. A claim on public land must be filed with the Bureau of Land Management or other federal agency, and the claim must be "worked" by being mined or prepared for mining within a specific period of time.

Maybe not as good as what's above but it is a legal definition.

I was lucky enough to find something in AZ that was next to a mine. It was a metal old prince Albert can with a piece of paper inside. I found it under this suspicious looking rock pile. I couldn't make out what was on the paper as it was very deteriorated. Was that a claim?
