which may strip our rights and completely end the days of Metal Detecting in Florida. Even if you don't live in Florida! This Bill may set a precedent in other states! It has been passed unanimously by the House (HB 591-CS passed as amended; YEAS 118 NAYS 0 on 2/16/2012) and the Senate Transportation, Tourism, and Economic Development Appropriations Committee. The Bill states that...any person who...removes or attempts to remove, or defaces, destroys, or otherwise alters any...specimen located upon land owned or controlled by the state or within the boundaries of a...[local government body politic] except in the course of activities pursued under the authority of a permit granted by the Division or under procedures relating to accredited institutions, commits a misdemeanor of the first degree. A person who engages in the same conduct by means of excavation commits a felony of the third degree...Individuals also are prohibited, and subject to criminal penalties, for selling or procuring objects which have been collected in violation of state law. CS/SB 868 expands the provisions contained in s. 267.13, F.S., related to prohibited practices and penalties to include state sovereignty submerged land (Includes Beach Land Below the High Mean Water/Tide Mark) and land owned by political subdivisions (Your local town/City). Any specimens, objects, and materials collected in violation of the law are forfeited to the state. Currently, the statutes only apply to land owned or controlled by the state, or within the boundaries of a designated state archaeological landmark or landmark zone. Thus, the bill affords protection to other public landowners, who are not covered by current laws and limited to other remedies such as trespass after warning...Our only hope to keep our hobby alive is to demand that Governor Rick Scott VETO this law! Can't stress it enough, it's not a new idea. We need to be good stewards of our hobby and the land. Fill in our holes, and any other holes we come across.
Sad but true. A few careless people could ruin it for all of us.

Called Florida Senate the SB 868 was not passed I was told and is now dead.
Also took the time to Call Senators office for the area I vacation in Florida. Plus The Representive of the House, Plus the Governors Office. Spoke to each assistant's that take messages. Spoke polite and let them know I vacation twice a year there. But would have to go else where if they denied metal detecting on there beaches. That was what I went there for on vacation. From a tourism point of view they took my name and info and passed it on. They said it was important info they needed to keep aware of. Tourism is there number 1 income.

The original Bill only stopped people from digging in State and Federal lands. Had nothing to do with Open Beaches and Private properties as some feared.

Between the Low and High water line NO ONE owns it. Getting to that strip of sand is not so easy at times.

That's great. It's different in the UK. The Crown Estate and council authorities claim that they own the beaches below the high water mark to mean low water mark....I was shocked when I found out. You don't need permission to MD, but they think they have the power to ban it in the blink of an eye if they wanted to (I have evidence of this) along with other long standing customs that go back centuries. I believe the beaches belong to everyone, no body, person or authority can 'own' a beach!! Crazy unfair world.

Yep, the U.K. is more then the Odd Man, errr woman out on rules. Lived there a number of years and have friends there today. Same situation with Gold Prospecting. Lived in Florida for three years but was tied to a short rope in the military at the time.
