	My first Arraignment was today. « on: May 21, 2012, 04:49:36 pm »

I was in court at 9:00am this morning concerning my 2 citations for pollution by using a dredge in a scenic waterway. I tried to get the judge to dismiss both charges because of ORS 133.060 I read it to the judge.
Under ORS § 133.060¹
Cited person to appear before magistrate

(1) A person who has been served with a criminal citation shall appear before a magistrate of the county in which the person was cited at the time, date and court specified in the citation, which shall not be later than 30 days after the date the citation was issued.

Summons # 988554 is dated 4-10-12 or 4-11-12 or 4-16-12
Summons # 988553 is dated 4-16-12

Today's date is 5-21-12 that equals out to 35 days

The judge said that the dates were very clearly 4-26-2012 and denyed my petition to dismiss.
I've been appointed a public defender named John Spicer. He's out of town until June 7th when I have an appointment with him.
My next court date is 6-19-2012 for my counciled arraignment. At this time I'll plead not guilty and ask for a jury trial. The date should be set at that time. I'll post more as it comes in.

Even though it's hard to determine the date on one of the summons. The other is questionable but the judge ruled it as 4-26-2012 even though the incident occurred on 9-26-2011. I think they're out to get me(us)

They are out to get anyone who won't bend the knee and back to them the almighty, know it all and sanctimonious government. Oregon needs a governor like Scott Walker to take on these totalitarian scum balls and stuff the constitution down their throats and then start reversing some of unjust laws and regs. I know you all think I'm smok'n some funny weed and have'n a weird dream, well tain't so I'm just a crazy old coot who wishes the Republicans would find someone with a set in his shorts and a fire in his belly to kick the Totalitarian/Socialist out of Salem.

Whether you like a law or not, it is the law. Whether you agree with a law or not, it is the law.

Stop bellyaching and face the music. You make all of us look bad no matter how righteous you act about it. Getting off on a technicality is not what you want. Want to reverse the law? Take appropriate action. Civil disobedience didn't work in the 1960s and it won't help now. Grow up. Obey the law.

Don't like the law? Change it. Now, go and pay your fines.

I have to agree with GD. You broke the law you got caught pay the fine and move on. If you don't like the rules/law then start a grass root movement and change them. All this whining is getting you nowhere. All this wrong date or other technicality crap proves to me that you know your wrong and are just looking for sympathy. Sorry we have no sympathy for folks that brake are bend the rules for personal gain.
