If I were the judge, I would say that Peru was not a sovereign entity, at the time, it was a small branch of Spain (no doubt and no matter that Spain looted the country, that is not at issue,) and as for Spain, I believe INTERNATIONAL Maritime law says there has to be a living 'person' remaining on the ship or it is deemed abandoned, since there was never any attempt to reclaim the ship and contents.
Spain is a country of maritime pirates, they have over fished Canadian coastal waters and the outer banks, until cod stocks have been depleted, they historically looted around the world, now they want to loot some of their lost loot.
It defies reason. Except that it has to be internal politics. Tell them to fly a kite! It is about as silly.
