Equipped to steal (UK).

"The offence can be committed by day or night. The offence cannot take place at the defendant's place of abode. It must be proved that he had the articles with him for the purpose of using them in connection with burglary, theft or obtaining property by deception though it is not necessary for the prosecution to prove that the defendant intended to use them himself. An intention to use the item if the opportunity arose would be sufficient to convict the accused, but it would not be sufficient where he had not actually decided whether to use the item if the opportunity presented itself."


Section 25 Theft Act 1968 (UK).

"(1) A person shall be guilty of an offence if, when not at his place of abode, he has with him any article for use in the course of or in connection with any burglary, theft or cheat.

(3) Where a person is charged with an offence under this section, proof that he had with him any article made or adapted for use in committing a burglary, theft or cheat shall be evidence that he had it with him for such use.".


Hmmmmm .... So as soon a my detector leaves the boundary of my property I would be be guilty, as charged !. I wonder how you guys manage to get your machines from your house to a place where you can legally use them ?.

more along the line for burglery tools --lock picks --crow bars and the like.  Wink

It did cross my tiny mind that a detector only detects. To be equipped to steal would mean carrying a digger, spade or JCB.

So, a Screw Driver in my back pocket could be construed as a burglary tool!   How Cool!


They Take away Firearms and now only the bad guys have them! Undecided

People buy Swards for home Defence and they take them Away! Shocked

Last I heard, there is a rash of people being killed with Mallets!!!! Idiot

quite right detectors only detect -- you need other items to "remove" whats found --- like a shovel or other "tool"

You sould design a detector with a 30 round clip in it. So when the coppers roll up on you, you could "let em have it" like the evil mastermind you are. You know I think its jealousy and ignorance. I mean If I want to just dig holes I can do that right, but ohh no he's using technology to give him an advantage over my hole digging, thats not fair. He bad.  Lets concentrate on criminals not citizens with productive hobbies. Tate
