Hi Hardluck

Could you or someone else reading know who the lost treasure would belong to, if found now?

Regards Smiley

Well the state can't take it from you as it does not belong to this government, it belonged to the old one that is non existent now.

Good luck convincing them of that in a court of law.

Time to wake up and take a good hard look at the facts. The gold belonged to the Boers (Die folk) it has and never will belong to the state of today, you will however have to pay a tax (Normal in today's society)

Wouldn't take much a government lawyer to argue that ownership of any gold belonging to a Boer government or collected, store, earmarked or otherwise designated for the support of said Boer government or governments and/or said government(s) armed actions against the British Empire and/or the subjects of the British Empire transferred to the British Imperial government with the signing of the Treaty of Vereeinging and that the current national government is the legitimate and legal successor to the British Imperial government in South Africa and that said "lost Boer treasure" was in fact the property of the government of South Africa which was therefore legitimately entitled to 100% of said "treasure trove", but in accordance with generally accepted principle the government would be willing to pay a "reasonable finders fee" of say 10-15%.   (And it really wouldn't matter too much what the treaty said about Boers retaining control of "personal property" as there is no evidence or proof that said treasure trove was the personal property of any individual and therefore it is to be assumed that it was the collective property of the Boer forces operating in opposition to the British Empire and its citizens.)

and that the current national government is the legitimate and legal successor to the British Imperial government in South Africa

It is not, remember that there is a previous government that would have been the legitimate successor to this treasure (That in fact dose not exist) First let me get a point straight, the gold never belonged to the British it belonged to the republic of South Africa and at no point did the British ever get their hands on it either, so as a successor of the British empire you still do not have the right to claim that gold as yours because it never and never will belong to the British empire. Also with out changing the subject the only reason as to why the British ever won the war was because they had the woman and children in the concentration camps and forced the Boers to surrender, Not because of the long tom or any other weapon. There is gold to be found but not where people are looking, and not in the quantity that they are dreaming about either.

X, personally I agree with you. And for a myriad of reasons, my sympathies lie with the Boer even if my ties to them aren't as strong as yours.
I'm just laying forth the argument that the South African government would use in a SOUTH AFRICAN court of law.
Don't trust lawyers, especially not government lawyers representing the "interests" (real or imagined) in a government courtroom.

Ok here we go,,,,, the facts of the lost Boer treasure  Wise

The treasure was made up of gold Kruger Ponds (pounds) this belonged to the Boers (Kruger) and not the British..... The British won the war, but not by being the victors, but more because all parties had just about had enough of the fighting, and also because most of the Boers were losing their properties and families to the British through the concentration camps and the scorched earth practice of burning the properties of the Boer soldiers so as to bring these soldiers out into the open. The practice of scorched earth was started to try and stop the Boers from leaving their homes and going into the forces, but this got way out of hand and just became a very bad practice which in the end cost the British.... The British would burn the house and take the family into concentration camps.... because it got out of hand, the British could not keep up with the amount of Boer women and children in the camps, therefore food, water and health became non existent and more women and children died i the camps than Boers died in the field.

At the end of the war, Kruger made his escape also ordering that the gold be removed to stop the British from getting their hands on the South African wealth. This is where the gold gets lost. There are so many stories about what happened to the gold, and through which towns it traveled, and also even if it left the country.

Where do we stand now in the NEW SOUTH AFRICA  No no! The fact is, when a country is taken over by a new government, that government also takes over the wealth and treasures of that land (sorry X ) so this would in all sense mean that the present government are now the proud owners of the Boer gold... Think of it the same as when I find Roman gold etc.... it is my duty here in the UK to hand it in to the present government, even though they are not the people who lost it.... it should belong to the Romans, but it does not.....

South Africa has a antiquities department who in all sense are like the rest of the departments bankrupt.... this is why all our historical sites are falling into disrepair, even as far as being knocked down as there just is no money to look after it..... Even people from other countries are coming into SA waters and raiding the shipwrecks and getting away with it because the SA government cannot afford to fight the cases in the courts to get the treasure back.

What now? Wow the sad part is, if you find the Boer gold, it actually belongs to the government.... but if you found it and took it, they probably would not have the money to fight you in court..... The British will pay you what the treasure is worth (more or less), where in SA, if you found it, they would just take it as they do not have money to pay you.... this is also why relics do not get handed in like they should. Even if you take them to a museum in SA, you will only get your name on a plate but no money.

Like it or not, that is the facts of the matter.... if you find, keep quiet and sell it off very slowly all around the world to a million different people  Shocked
