I think they treat it just like Bald Eagle feathers, it is illegal to have them also, since they are endangered species.   They automatically assume you killed the animal to acquire the item.

Killing a whale to get the ambergris is a bit like killing the chicken to get the eggs, totally senseless on the other hand I can understand why having bald eagle feathers is considered a crime.
