Private property with permission even you own is cool.   The Government no longer looks at the US We the Peoples property as out own.

A bad day at gold prospecting or metal detecting is better than a good day at work.

I'm not a part of events like this, I would let the authorities handle it if I came across things like this (Indian burial grounds, large caches, structures, camps, etc), I'm quite confident with my luck so far in metal detecting, my findings will never fall within the scope of this

I know the feeling.  Most of us are the same.
The real treasure its to be out there. Detecting Detecting
But been aware of the Law will help you if the unexpected happened.

I heard that! My best days are outside in nature digging in the sunshine with my cat monitoring every move and inspecting every bottle cap, I am so glad spring is here.  The tomato plants went in today and all weekend I will be metal detecting - yahoo!

Well Homie, I still didn't see it, but from other sources, I  have read that wilderness  areas, pristine areas, and preserves are off limits to metal detecting. While National parks, state parks, as well as city parks, have regulations against removal or destruction of plants and vegetation, antiquities, and public property (you know, benches, lighting, signs, tables, etc.). Mechanized equipment like backhoes, and bulldozers, are out too. Recreational detecting is hardly ever forbidden, or at least enforced, but commercial treasure hunting is forbidden without special permits.
If you find that lost quarter, pick it up when no one is looking. It probably silver.

Carl, Yea things are messed up.   ARPA  has been interpreted to mean what ever some not all Archilogcal folk think.   Fact is you can't touch any thing over 100 years old and they have some how interpolated it to 50 years.   Don't ask me how.  LOL.

I seem un able to find the post on the 50 year thing.   On State or Federal Lands it states 100 years but some now there reinforcing 50 years.

Here in new Mexico there was a guy given a $700.00 ticket for 5 cut nails he had found .

Some place in the Mess is the Answer.

Sorry I  took so long getting back at ya. There was a lot to read. I didn't find the 50 year thing, but I  am aware of the 100 year description. Any town that is a ghost town or is on the historical place register list is protected to the extent of those laws. There are other laws that can help to protect you against the not so informed law keepers. Two come to mind. Laws of common usage and the so called theft by finding laws. I know the last one sounds like it is against us, but if an object that has been found that is on public lands, and that is not an artifact or historical item nor an Indian or previous civilization artifact, nor has a way to prove previous ownership, belongs to the finder of such. I found a mistake in the quote about the 1966 antiquities act where the word information is used in that he left out the word before which is "historical".
Pick up that quarter Homie, and if they give you static, you and will grab us some authentic copies of those three laws and drag them all down to the Supreme Court and make them prove their case. And that is another  law. You are innocent until proven guilty no matter how insinuating the circumstantial evidence is.

Dusty Carl

PS If it is dated before 1915 leave it there unless you have proof of ownership and there is a way that you can prove that particular one is yours.
