Code of Federal Regulations, 36 CFR 261.9: "The following are
prohibited: (g) digging in, excavating, disturbing, injuring, destroying,
or in any way damaging any prehistoric, historic, or archaeological
resources, structure, site, artifact, or property. (h) Removing any
prehistoric, historic, or archaeological resources, structure, site,
artifact, property."

USDA Forest Service Manual Direction (draft): "Metal Detector Use. Metal
detectors may be used on public lands in areas that do not contain or
would not reasonably be expected to contain archaeological or historical
resources. They must be used, however, for lawful purposes. Any act with
a metal detector that violates the proscriptions of the Archaeological
Resources Protection Act (ARPA) or any other law is prosecutable.
Normally, developed campgrounds, swimming beaches, and other developed
recreation sites are open to metal detecting unless there are heritage
resources present. In such cases, Forest Supervisors are authorized to
close these sites by posting notices in such sites."

ARPA, 16 U.S.C. 470cc: "No person may excavate, remove, damage, or
otherwise alter or deface or attempt to excavate, remove, damage or
otherwise alter or deface any archaeological resources located on public lands or Indian
lands unless such activity is pursuant to a permit. . ."

You are reading it right.   Keep in mind, though, that some ranger offices are more restrictive in their interpretation of the regulations than others.   There are those out there that will nail you for digging up a 1962 Franklin Half since it is over 50 years old and therefore (in their minds anyway) covered by ARPA.   Others are much more lenient and will give you a lot more leeway as long as you are staying well clear of obvious sites or places where you would reasonably be expected to find historically or archaeologically significant finds.

I wouldn't even have a detector in my truck till I talked with the head ranger at said parked then I would only hunt when he was on duty. As BA said there are lots of gun ho rangers out there that see the law different then it was meant to be.

thanks for the info guys.there is a ranger office about a half hour away,i will stop in the there and get clearification.i hear you about the gung ho rangers,that's what worries me.

You want to watch where you go in them woods etc anyway. There is a lot of illigal weeds growers out their to get you shot at or hurt. I live in SW Mo and we are notorious for weed growers here in the ozarks. I have ran into a few that I just back off and get in my car and go some wheres else.as dont know if feds or owners are watching.

Here in NM you can Gold Pan in the Creeks but if they catch you diging in the Banks or Moving Big Rocks your are done.
