Hi everyone!  I am new to metal detecting as well as message boards so thank you for your patience in advance.  I am curious for everyones opinion about which metal detector would be best.  Also I would like to know the unspoken "rules" if you would, in regards to exploring private property.  I understand you have to first obtain permission, but when seeking that permission do you fully explain why you are there, and if so if you discover anything does the property owner have first rights to the objects found?  Is it best to reach an agreement before you begin looking or does that put the property owner thinking toward a slice of the possible cake?  I do not want to do anything underhanded or unethical.  My concern is that what I find maybe taken from me.  Thanks for taking the time to help answer the first set of questions to be thrown your way.  Good Luck

Hi Nike, welcome to THunting.

That's a good set of questions you asked.

With regard to the best detector, that's been kicked around here a lot.  My recommendation would be to use the Advanced Search feature at the top of the board and search "Entire Forum" for "Best Detector".    One of the things you'll find out is that the answer is going to depend on what you mainly plan to use the detector for and how much you have to spend.

With regards to questions on getting permission, that's also been debated a lot, so you'll probably want to check that also, but it is worth another look anyway.   I'd say most of the time you don't need written permission, but do make sure you care the name and phone number of the person who gave you verbal permission---especially when dealing with people you know.   Most of the time it also isn't necessary to go into a lot of detail about what you do or what you're looking for, just so long as the owner understands that you'll be making "small" holes in their yard which you will carefully cover back.

Even if you think you'll be ok with verbal agreements, it's probably a good idea to carry blank written agreements just in case the owner wants something in writing or you get the feeling it might come in handy.   I definitely would use a written agreement if the owner is expecting a portion of your finds (which isn't to say you shouldn't offer a momento after your done hunting anyway).   I'd also usw a written agreement any time you have even an inkling that it might be appropriate (better safe than sorry).

Do not quote me on this BUT as far as I know all treasures found belong to the state and not to the owner of the land. But you will get something for finding it and that?s where a agreement with the owner of the land can be very important or you may just find your self with nothing to show for it.

Xavier, whether trove belongs to the nation or the land owner or the finder depends upon the nation.   Fortunately for Americans, Congress has not yet declared federal ownership of trove found on private land or on land belonging to the individual states.   I wouldn't put it past the current office holders to try to do so.

Hi Xavier

Thanks for the info and thanks for taking the time.  I do appreciate it.  I am always looking for more information.  I never thought of the government having any rights just the property owner.

Angry You can never be to sure with those guys they seem to make up the rules as they play the game. Any how it?s always best to have a written permission that way what ever happens you can say I have permission here it is and don?t show the original  just a copy.

nike, I've detected for 26 years and never had any paperwork written up before doing a search. I have had verbal agreements. I suppose the written agreement would be better if you find some seriously valuable items such as a big cache(buried or hidden money or valuables) on someone's property. I've heard of cases where caches were found and the land owner who gave a verbal agreement recanted and acted like there was no agreement and got all the valuables found--I'd hate to be in the finder's shoes in that case.
