It is already happening. Once an area is declared wilderness, the public is screwed. Wilderness areas require a permit just to go for a hike or raft down a stream. The permits can take years to go through and then you have to follow a set of rules that seriously won't allow a person to shit in the woods... a bear can, but people can't. Scenic is another problem one. You can look at it but if you touch it, it is a federal offense. National parks and a tad bit better, but still horrible. The national park to the north of me is so strict they have been known to (not joking or exagerating) right a ticket to the parents of a 5 year old who was digging on the beach with a plastic shovel and plastic bucket. It will get worse before it gets better, but right now our society frowns on mining, hunting and fishing as they have been wrongly portrayed. When the general public thinks of hunting, they think of a drunk redneck poaching. When they think of fishing they think of the illegal fishing vessels that are literally wiping out entire species of fish. When people think of prospecting or mining, they think of some sort of major environmental cleanup... like a cyanide leak. Our best hope is to continue what we do and introduce as many people to the activity as possible, all the while be respectful and courteous to land rights, laws, and other peoples views. You don't win an argument by yelling louder... you win by being smarter.

That would depend on the lands you wish to hunt.

BLM, Forest Lands,   The rules have already been drawn.  There Are No Permits.  Removal of any material from Forest Lands is a NO NO!

gOOgel BLM and it's all posted on the main site.  Open to Prospecting of Locatable Mineral.   You have to Read it.  

Some BLM lands have been withdrawn from Location.

gOOgle US Forest Service and you will find the same.

Seriously, people... I live in Washington and I prospect in Washington and Idaho. I know where to get permits and information and I know most of it by heart for both of those states. If I were to go to AZ, CA, NM, OR, or any other state I would research for each individual state. It is a huge hassel, but it has to be done if you do not want to be cuffed and locked up. In each state prospecting is controlled by an entity. In Washington that entity is the Washington Department of Fish and Wildlife, and in Idaho the agency is the Idaho Department of Water Resources. I absolutely hate the fact that there are so many people that want to just try something as simple as panning, but the guberment has made it so difficult that you can literally go to jail for panning! I will be posting a topic sometime tonight about what we can all do to make it easier for all of us to do what we enjoy and to help others new to the hobby.
