since the very nature of the hobby is to find and show pieces of history why should people be put in jail for it.that makes no sence.or is it a matter of the government wanting their cut

i think there are a lot of ridiculous double standards when it comes to indian relics.  it is illegal to "dig" for artifacts around here in east tn, yet supposedly if you find something laying on top of the ground you can keep it.  everyone i know that has been caught walking the river banks in the fall when the water is low has had their finds seized at the very least, and usually get a fine as well.  it seems that if you are in possession of relics they assume you dug for them.
 i like finding arrow heads as much as anyone, and the few nice ones that i have found, i would never sell or try to make a profit from. i might give them away to kids in hopes of stirring up an interest in history or archeology, even though i think most archeologists are hypocritical asses.
it burns my rear end every time i go to the local court house to pay land taxes or renew my license plates for the car and have to see all the "seized" arrowheads they have hanging on the walls.  they have them glued onto canvas in the shapes of various famous paintings.  makes me wonder why they cant be hanging on display on the walls of the people who spent hours trudging in the mud finding them.

So whats to prove something is an "Indian Artifact". For all we know it could have been made be some 10 year old kids or someone that was not Indian. Sure we could carbon date it to prove a time period be I'm sure the finger prints of that person are long gone. I make " stuff" all the time I am not Indian.

I believe that private land is an exception here in NM if I read right. But it's really "worded" very precise regarding NA artifacts on private land. But under the established rules & regs, they can be had.

In September 2003, I appeared on the TV program 'History Hunters' on @Discovery Canada which was being filmed at the Royal Ontario Museum on Toronto. I had with me a 500 year old Ohio area Moundbuilder effigy pottery bowl. I am not now or was an archaeologist. They asked me how I came to own it and I mentioned that I traded some of my personal artwork for it and a 1920's Chitimacha handwoven purse from a trader from York, Pennsylvania. Nothing bad happened to me. I wasn't arrested nor was my bowl confiscated. Perhaps because this took place in Canada and the trade took place on an Unceded Indian Reserve. It may have also been because I had been a Featured Artist during the R.O.M.s Spring Break Show two years in a row and was already an acquaintence of the the Ethnology Department. Perhaps I am fortunate not to live in the United States. You would be amazed however to learn how much pottery from these same Mounds are scattered in private collections around the world. Mine is in pristine condition. I would still be in jail today if anyone had tried to take it from me.

Anyone ever hear of the "Kennewick Man" skelton found near Kennewick, Washington (I think in the 1990's)? It was dated to be the oldest skeleton in North America...and it was of a caucasoid man! It got taken out of public site very fast, the site where it was found was destroyed by the Army Corps of Engineers, the skeleton was reburied by 'native americans', and the archaeologist who did the work to come up with what the skeleton had looked like...had his career ruined. I'm caucasian so maybe most of these artifacts should belong to my tribe of caucasians and caucasoids. Do you suppose that arguement would stand up in court?
