), a gold prospecting supply shop located in the Bay Area, is shining light on a California State Budget loophole which is being exploited by Legislators to enact last minute laws on pet projects and further increase California's budget deficit.

"Californian's have no idea how much their local Legislators are really costing the State," says Mike Dunn, owner of Gold Pan California. "Through secret use of budget trailer bills, Legislators are feverishly creating last minute laws with no bill numbers and no accountability or fiscal responsibility for these new laws."

In this instance, Jared Huffman (D) San Rafael is in the glare of Dunn's spotlight.

Budget Trailer Bills are intended for the implementation of fiscal decisions, and statutory changes to implement those decisions are constitutionally due to the Legislature by February 1, five months before the budget deadline of June 15th.

Yet, three weeks ago Huffman inserted four paragraphs of new "language" i.e., statutory changes, into a 100-page resources folder, which will be given a trailer bill number and presented to the Governor shortly. Governor Brown does not have line-item veto authority in this scenario.

This last minute legislation-by-default totally circumvents participation by the public. Equally wrong, it absolves the Legislator from any financial consequences or accountability for the legislation, since his name isn't on it. Numerous calls to Huffman's office have gone unanswered this week.

The practice of stuffing trailer bills is familiar among gold prospectors. Huffman also used the tactic during the 2011 budget countdown.

Modern day gold prospecting is conducted by suction dredging underwater. Huffman's 2011 trailer bill legislation caused a temporary moratorium on suction dredging for gold until 2016. His current trailer bill language would essentially ban the practice forever.

Suction dredging for gold is touted as being environmentally harmful by the Karuk tribe and environmentalists. Curiously, the same anti-mining foes are seeking $9 million from California taxpayers to dredge for mercury in the State waterways. Dredging is legal in virtually every waterway, year round for numerous purposes - unless, that is, you're dredging for gold. That's outlawed in the Golden State.

The news gets worse for California taxpayers if the new language becomes law. The State is involved in seven lawsuits between gold prospectors and anti-mining foes. Those lawsuits have been active since 2005, and if Huffman's trailer bill language is schlepped over to the Governor, the State will be committed to spending untold amounts on future litigation, before the current multi-million dollar lawsuits are settled.

There are 56,000 gold claims in California, with just 6 being in Huffman's district. The title of Huffman's four paragraphs is "Suction dredge cleanup language."

"If I were one of his local constituents," states Dunn, "I would be quite interested in seeing what else was being crammed in un-named envelopes during the late-night budget negotiations."

With seven lawsuits already underway and deep budget cuts on the imminent horizon, hopefully Huffman will pull his four paragraphs out of the budget trailer bill to save the few million dollars for badly needed social services or education.

Dredging to get the mercury out of fresh water is environmentally responsible action. I see no cause for alarm here unless you want to deliberately stir the pot. You cannot compare removing deadly poisons by dredging to recreational mining by dredging. In principle, I am behind your dislike of dredging restrictions 100% but this is an unfair comparison.

Dredging is Dredging.   I just find it Ironic that the Same folks that say the Gold Dredgers harm the fish want to dredge.

What do you think there going to do with the Gold they recover?

If they want the Mercury, they have to take the Mercury Coated Amalgamated Gold with it.

I have over a 1/4 lb of the stuff I recovered from Gold I  Sluiced alone.

I have a spot that I find Gold like that all the time.

Yes it's the same system with exception that the Gold Dredger is limited to a 2 or 4" hose.

These guys are going to be using  any thing from 4" to 10" or more.  

Really I have no Idea how there going to do it but I bet it's more intrusive then the Small Miner.

This Mercury has been in place for Years and Years.

There just going to be Kicking it up and Sturing it into the Waters.

This has nothing to do with the Mercury they will be forcing you to have in your homes in the next few year in CFC light bulbs.

You Know, The ones that will Sun Burn You if you sit too close?

The Light Bulbs that you have to by law May have to involve the EPA if they Brake in your home?

If we dont get accountability and reform, we will loose everything. Im not just talking about dredging here. Im glad there is people watching, and reporting. When we shut up and ignore the problem they go for the juggler. Once these laws take effect in California its a matter of time before they spread into other states. Our natural resources are to be enjoyed by everyone, in a book with pictures only. It wont be long before our detectors and pans are hanging on a IHOP restaurant wall somewhere.

If your truck was not California Approved it would cost you about $3,000 Less.

You would be getting about 5-10 MPG more without all that crap.

It's sorta like a BACK AZZ circle.

They sit around and out think everything so they can tax it, track it, and control it. Smoke and mirrors so people wont think about the real problems.  Here is a example. A study found that methane from Cow poop, (the cows we ea) contribute more to Global Warming (a natural recurring event) than all the automobiles on the road. The trucks and cars on the road were designed to run better at higher speeds, and less back pressure caused by the epa required stuff. The main problem with gasoline is the engines don't burn the fuel efficiently. So when I see a volt that gets 40 miles to a charge, whoop ti do. Fossil fuels can be made to burn much better. The designs have been out there for many years.

So we pay for a car that doesn't last 10 years, has to have a warrenty and a extended warrenty so you only pay the $500 deductible to operate it, plus insurance, upkeep. See where Im going, why is it so hard to say take a flight or drive a car? From what I seen most people cant drive anyway.

So now you have a dredge, which is like a car or boat, a big hole you throw money in. The state wants you to quit spend money on your dredge and throw it there way on the new taxes you got comin next year. I have always base my personal finances on a pie chart. I can tell how much of my income is being spent on what. I see the people responsible for these money making laws pies getting bigger, and my pie shrinking. Well guess what, the pie is gone.

To ban a recreational reason to go to these already poorly run parks and use the resources the state cant maintain is backwards thing to me. Only people getting use of em now is the criminals who hide in em and do bad things there. Never thought of carrying a gun before, but now I do. A commercial dredge can do some damage, but a small recreational dredge? Thought about buying one myself. I just dont know what they are talking about when they ban stuff.

I used to have several large fish tanks that required me to clean the gravel in them. Seems water quality should be the issue and not some guy trying to get ahead and having fun doing it. I hope some of you jackasses that are writing the laws are reading this. I always spell out my feelings on this to the new law makers coming in with a welcome note. I have seen its effects.

As a ambassador I always try to cart out at least one 5 gallon bucket of trash when Im fishing, or hiking or what ever. I am the example, I hope all follows. This has been done for years. Its my land too, and we all need to share. Think Im gonna start carrying "Tanks Your Welcome" for all the dont have fun signs I see out there.

LOL! Like Ethanol in Gas Reduces the MPG you get but cost you more.

Yep, More Smoke and Mirrors.

You end up Burning More Gas / Ethanol in the end to do the same thing.   Your not Saving any thing in the end.

History repeats itself and no one cares. Its sad really. The local paper was doing a article on imigration reform in New Mexico. Its not about one people or type of people. Its about us all. It will soon be illegal to leave ones state if it keeps up. get rid of the bad laws and lawmakers. There is a 50oz nugget waiting to be found, I just know it. Save our dredge, save or dredge.

Really though, these little chunks of personal freedoms being eroded away is very serious indeed.
